Sec. 201.1 Authority.
(a) Authorities and responsibilities related to and bearing upon national
security and emergency preparedness telecommunications matters are set forth
in:
(1) Section 706 of the Communications Act of 1934 (48 Stat. 1104, 47 U.S.C.
606), as amended.
(2) The National Security Act of 1947, as amended (61 Stat. 496, 50 U.S.C.
402).
(3) The Federal Civil Defense Act of 1950, as amended (50 U.S.C. app. 2251
et seq.).
(4) The Disaster Relief Act of 1974 (42 U.S.C. 5121 et seq.).
(5) The National Science and Technology Policy, Organization, and Priorities
Act of 1976 (90 State. 463, 42 U.S.C. 6611).
(6) Executive Order 12046, “Relating to the Transfer of Telecommunications
Functions,” March 27, 1978 ( 43 FR 13349 ; 3 CFR, 1978 Comp., p. 158).
(7) Executive Order 12472, “Assignment of National Security and Emergency
Preparedness Telecommunications Functions,” April 3, 1984 ( 49 FR 13471 ; 3
CFR, 1984 Comp., p. 193).
(b) Authorities to be exercised in the execution and performance of
emergency functions are subject to the provisions of the National
Emergencies Act of 1976 (90 Stat. 1255, 50 U.S.C. 1601).
