Sec.  87.191   Foreign aircraft stations.

   (a) Aircraft of member States of the International Civil Aviation
   Organization may carry and operate radio transmitters in the United States
   airspace only if a license has been issued by the State in which the
   aircraft is registered and the flight crew is provided with a radio operator
   license of the proper class, issued or recognized by the State in which the
   aircraft is registered. The use of radio transmitters in the United States
   airspace must comply with these rules and regulations.

   (b) Notwithstanding paragraph (a) of this section where an agreement with a
   foreign government has been entered into with respect to aircraft registered
   in the United States but operated by an aircraft operator who is subject to
   regulation by that foreign government, the aircraft radio station license
   and aircraft radio operator license may be issued by such foreign
   government.
