  § 5.1   Basis and purpose.

   (a) Basis. The rules following in this part are promulgated pursuant to the
   provisions of Title III of the Communications Act of 1934, as amended, which
   vests authority in the Federal Communications Commission to regulate radio
   transmissions and to issue licenses for radio stations.

   (b) Purpose. The rules in this part provide the conditions by which portions
   of  the  radio  frequency  spectrum  may  be  used for the purposes of
   experimentation, product development, and market trials.
