- ATC Requirements The Commission's decision to permit implementation of MSS ATC was based on the premise that ATC must be ``ancillary'' to MSS operation. To that end, the Commission established ``gating'' requirements for ATC authorization and operation to ensure that ATC will augment, rather than supplant, MSS. In order to satisfy the gating requirements, which are set forth in Section 25.149 of the Commission's rules, an MSS-ATC licensee must, among other things, maintain spare satellites and replace failed satellites within a reasonable period of time and must integrate its offering of ATC services with its offering of MSS. We discuss MSV's compliance with these particular gating requirements below. Integration with MSS: Dual-Mode Terminals An ATC applicant must demonstrate that it will

Subpart B - Applications and Licenses - Space Stations: Section 25.140 provides for the general qualifications required of fixed-satellite space station licensees including procedures to facilitate coordination to avoid harmful interference. Sections 25.142 through 25.149 provide licensing procedures for particular services or classes of satellites. Subpart B -- Applications and Licenses - Processing of Applications and Forfeiture, Termination, and Reinstatement of Station Authorizations: Sections 25.150 through 25.163 include well-defined procedures for processing applications to determine whether the applications are mutually exclusive. Sections 25.157 and 25.158 prescribe space station licensing procedures that minimize processing delay and

- Part 2, Subpart J of the Commission's rules before the terminals are offered or imported for sale or lease in the United States. In the ATC Report and Order, the Commission adopted rules establishing several prerequisites, or ``gating criteria'' that MSS operators must meet in order to be allowed to offer ATC. These gating criteria are set forth in Section 25.149 of the Commission's rules. To ensure that ATC will be ancillary to provision of MSS, the Commission adopted a requirement that MSS operators must provide substantial satellite service to be eligible for ATC authorization. The Commission defined substantial satellite service as the capability of providing continuous satellite service over the entire geographic area of satellite coverage required in our rules,

In 2003, the Commission adopted rules under which an MSS operator can obtain authority to operate an ATC - that is, terrestrial base stations and mobile terminals that re-use frequencies assigned for the MSS system's operations. In order to obtain ATC authority, an applicant must satisfy certain ``gating'' requirements, which are prescribed in Section 25.149(b) of the Commission's rules, to ensure that the ATC operation will be ancillary to MSS operation. Among other things, Section 25.149(b) requires an ATC applicant with a geostationary MSS system to certify that it will have a spare satellite available on the ground within one year after commencing ATC operations and will launch the spare satellite in the first commercially

- charge when the latter became available. The Commission addressed Globalstar's modification application in a decision released in October 2008. First, the Commission discussed the issue of Globalstar's compliance with the requisite ATC gating criteria. The Commission concluded that the first-phase plan to offer S-band ATC service in conjunction with first-generation Globalstar MSS was inconsistent with the gating criterion in Section 25.149(b)(1)(iii) of the Commission's rules that requires MSS coverage to be continuous throughout the United States, Puerto Rico, and the U.S. Virgin Islands. The Commission noted that the first-generation Globalstar satellite system was not providing continuous coverage throughout the United States for S-band downlink signals, but instead only coverage for one-way, transmit-only services using Globalstar's L-band uplink spectrum. The Commission held
