Discussion We find that good cause exists to grant the requests from the D.C. and New Jersey Commissions to permit the retroactive distribution of federal universal service support to Bell Atlantic-DC, United-NJ, and Bell Atlantic-NJ. In so doing, we conclude that the D.C. and New Jersey petitions meet the specific requirements of section 54.201(a)(2) for waiver of the requirement that only carriers designated as ETCs may receive federal universal service support after January 1, 1998. Generally, the Commission's rules may be waived for good cause shown. As noted by the Court of Appeals for the D.C. Circuit, however, agency rules are presumed valid. The Commission may exercise its discretion to waive a rule where

No parties oppose our proposal to eliminate this section. We therefore eliminate section 53.101, as set forth in Appendix B. Part 54 - Universal Service Subpart C - Carriers Eligible for Universal Service Support.
