- it is necessary to suspend the ATS rates of all price cap LECs -- even those whose ATS rates may not raise substantial questions of lawfulness when viewed in isolation. Under the Commission's recently adopted rule revisions, price cap LECs must make a collective $2.1 billion reduction in switched access usage charges in their 2000 Annual Access Tariffs. Under section 61.48(l), each price cap LEC's reduction is affected by the reductions of the other price cap LECs. Thus, if any price cap LEC's ATS rates need to be recalculated in this investigation, they will all need to be recalculated. Accordingly we will suspend the price cap LECs' 2000 Annual Access Tariff filings, to the extent indicated in paragraph 2, supra. The

Finally, the Bureau suspended the ATS rates of all price cap LECs because, under section 61.48(l) of the Commission's rules, the amount of each price cap LEC's reduction is affected by the amount of reduction taken by the other price cap LECs. Thus, if any price cap LEC's ATS rates would need to be recalculated in this investigation, they would all need to be recalculated. 3. In this Order, on our own motion, we reconsider our

- FCC Rcd 4122, 4163-64 (2004) (Second MAG Further Notice). Windstream Order at para. 9. WorldNet Opposition at 2, 5-6. Id. at 3. 47 U.S.C. § 201. WorldNet may challenge PRT's price cap rates on this basis when PRT files tariff revisions and also may seek prospective relief on this basis through enforcement proceedings. WorldNet Opposition at 1. 47 C.F.R. § 61.48(d)(2) (1996). Windstream Order at para. 18. . We disagree with WorldNet's assertion that, because wholesale unbundled network element (UNE) rates are significantly below PRT's retail special access rates, those special access rates should be reduced. See WorldNet Opposition at 4-6. Commission rules require incumbent LECs to price UNEs at total element long run incremental cost (TELRIC) rates. See 47 C.F.R.
