  • WWWP-LP, Wauchula, Florida, seeking reconsideration of the dismissal of its referenced license application (the ``Application''). For the reasons set forth below, we deny the Petition. Background. WEBC's construction permit, as modified, contained the following condition: ``Both prior to construction of the tower and subsequent to the installation of all appurtenances thereon, a partial proof of performance as defined by Section 73.154 of the Commission's Rules, shall be conducted to establish that the AM array [of Station WAUC(AM)] has not been adversely affected and . . . the results submitted to the Commission.'' WEBC filed the Application on December 12, 2003, without satisfying the condition requiring a partial proof of performance. On June 28, 2004, the Commission sent WEBC a letter requiring

The Stations maintain that the measurements show that installation of their DTV facilities ``has not adversely affected the directional antenna system of WNWR.'' Global disagrees, arguing that the measurements actually show that, in the case of every radial measured, the field at each such azimuth increased in intensity following the construction of the Stations' new tower.

These proofs are conducted to verify that the array remains properly adjusted. 1. Number of Points Required . Presently, 47 C.F.R. § 73.154 requires that permittees make at least 10 field strength measurements within 3 to 16 kilometers from the array at radial locations used in the last complete proof of performance. If a radial contains a monitoring point, that point must be included in the measurements. . Proposal. We propose to reduce to 8 the required minimum number of points per radial.
