This Forfeiture Order (``Order'') imposes a forfeiture against Bay Broadcasting Corporation (``Bay'') in the amount of nineteen thousand dollars ($19,000). We conclude that Bay willfully and repeatedly violated Section 301 of the Communications Act of 1934, as amended (the ``Act''), and Sections 73.1201, 73.1675, 73.1690 and 74.1251 of the Commission's rules. The violations include: operation without Commission authorization of studio-transmitter links (``STL'') for stations KHSN(AM), Coos Bay, and KACW(FM) and KBBR(AM), both in North Bend, all in Oregon; failure to broadcast required station identification announcements on Station KHSN(AM); use without Commission authorization of a long wire antenna for KHSN(AM); relocation without Commission authorization of

The design utilized an alternate transmitter and three television booster stations, operating at increased power, spaced throughout the island. In 1992, the Commission granted Siete Grande waivers of Sections 73.1675(a) and 74.735(d) of the Rules in order to permit operation of the multi-station facility on a regular basis. The applicat ion could not be approved since the proposed auxiliary facility's 1 mV/m contour extended beyond the lice nsed main facility's 1 mV/m contour, in violation of 47 CFR 73.1675. On November 12, 1991 a petition for reconsideration of this action was filed.(FN1) This petition for reconsideration is the subject of this lette r. The petition for reconsideration notes that the staff determined the 1 mV/m con tours for the main and proposed auxiliary facilities using radials spaced every 5 of azimuth.
