On December 22, 2006, the Enforcement Bureau's San Francisco Office issued a Notice of Apparent Liability for Forfeiture (``NAL'') in the amount of $4,000 to Del Rosario Talpa for operating station KNCR at an unauthorized location. In this Order, we consider Del Rosario Talpa's arguments that its violation was actually of Section 73.1680 of the Rules; that Del Rosario Talpa will have financial difficulty paying the forfeiture amount; and that the forfeiture amount should be reduced based on Del Rosario Talpa's history of compliance with the Commission's Rules. - This is a Notice of Violation ("Notice") issued pursuant to Section 1.89 of the Commission's Rules to Citadel Broadcasting Company, licensee of radio station KKND-FM in Belle Chasse, LA. 2. On February 1, 2010, an agent of the Commission's New Orleans Office monitored radio station KKND-FM located at Belle Chasse, LA and observed the following violation: a. 47 C.F.R. S: 73.1680(a): "An emergency antenna is one that is erected for temporary use after the authorized main and auxiliary antennas are damaged and cannot be used." While monitoring KKND-FM, the agent from the New Orleans Office observed the station operating from an emergency antenna for approximately one hour. The station reported it operated from the emergency antenna to conduct maintenance testing. The

- WSTX(AM)'s antenna tower on November 18, 1999, and that it had been operating WSTX(AM) with a long-wire antenna since that time. By letter dated June 12, 2000, ASD granted Family STA to operate WSTX(AM) with an emergency long-wire antenna with reduced power until December 12, 2000. ASD found that the STA request, although untimely, otherwise met the requirements of Section 73.1680 of the Commission's Rules (``Rules'') regarding use of emergency antennas. However, ASD stated that the STA granted for WSTX(AM) did not cover the period between November 18, 1999, and June 12, 2000, and is ``without prejudice as to whatever action the Commission may take with respect to any unauthorized or improper operation of Station WSTX(AM).'' On December 22, 2006, the Enforcement Bureau's San Francisco Office issued a Notice of Apparent Liability for Forfeiture ("NAL") in the amount of $4,000 to Del Rosario Talpa for operating station KNCR at an unauthorized location. II. BACKGROUND 2. On August 22, 2006, in response to a complaint, an agent from the Enforcement Bureau's San Francisco Office monitored KNCR's signal on

On May 5, 2006, the staff granted the Licensee's Petition for Reconsideration, holding that the Licensee had provided conclusive proof, consisting of Commission date-stamped STA requests, that the Station resumed operations on April 27, 2000, with an emergency antenna as authorized by Section 73.1680 of the Rules. Thus, the staff found that the Station had not been silent for twelve consecutive months, reinstated the Station's license, and admonished the Licensee for its failure to request authorization for emergency facilities within 24 hours of April 27, 2000. 8. By its terms, the December 2004 STA expired on June 1, 2005. Nevertheless, the station continued to

In the absence of interference complaints, lesser variances shall be considered minor variations in operating parameters subject to the corrective actions called for in Section 73.62 of the Commission's rules. The Commission's rules already provide for reduction of operating power to eliminate excessive radiation. In addition, Section 73.1680 provides that if AM directional antenna systems become damaged and can no longer operate properly, prior Commission approval is not required for licensees to commence operation with an emergency nondirectional antenna and power reduced to 25 percent or less of the nominal licensed power, or a higher power, not exceeding licensed power, while ensuring that the radiated field strength does
