- ) CSR 5459 Adopted: June 15, 2000 Released: June 19, 2000 By the Chief, Cable Services Bureau: introduction In the above-captioned proceeding, Home Shopping Club (``HSC'') filed a petition seeking a waiver of the Commission's closed captioning requirements. HSC maintains that requiring its programming to comply with the Commission's closed captioning requirements constitutes an undue burden as defined by Section 76.1(f)(2) of the Commission's rules. An opposition was filed by Telecommunications for the Deaf, Inc. (``TDI''), to which HSN filed a reply. background Section 713 of the Communications Act of 1934, as amended (``the Act''), Video Programming Accessibility, was added to the Act by Section 305 of the Telecommunications Act of 1996. Section 713 generally requires that video programming be closed

Cable One notes that the Commission has previously ruled that Grade B contour coverage is an important factor in determining that a station provides local service. In addition, Cable One states that KJRH is geographically close to the communities - KJRH's transmitter is 70.1-77.2 miles distant and its city of license 76.1-82.3 miles distant. Cable One maintains that these distances are well within the range in prior Commission decisions in which the television station was considered to be local to the communities at issue. Cable One argues further that KJRH's programming serves the needs and interests of the communities. Not only does it offer numerous local news, sports and community interest programs,

- we modify the DTV allotment provided for this station. It submits that operation of WHSV-TV's DTV service on channel 49 with 91.1 kW ERP, as provided in the Sixth Report and Order, would result in loss of service to roughly 100,000 viewers due to avoidable interference. Benedek points out that operation on this channel would allow WHSV-TV to replicate only 76.1 percent of the station's service area. It further states that population growth is expected in the area not replicated. Benedek submits that it is studying the available VHF channels but that because of the limited time available for engineering evaluation and the unavailability of OET Bulletin No. 69, it has not been able to determine the most appropriate alternative.

- 14 FCC Rcd 4720 (1999) (``Form 325 Order''). Until 1998, all of the approximately 11,000 cable systems in the country were required to file Form 325. The Form 325 Order reduces the number of filing systems to the 700 systems, approximately, that have 20,000 or more subscribers. Those 700 systems serve 70 percent of all cable subscribers. 47 C.F.R. §§ 76.1-76.1514 .
