- NOTICE OF APPARENT LIABILITY FOR FORFEITURE Adopted: September 21, 2007 Released: September 21, 2007 By the Chief, Enforcement Bureau: Introduction In this Notice of Apparent Liability for Forfeiture (``NAL''), we find that Comcast Corporation (``Comcast''), which operates an affiliated regional cable network, CN8, is apparently liable for a forfeiture in the amount of four thousand dollars ($4,000) for violating Section 76.1615 of the Commission's rules. This rule generally requires cable operators engaged in origination cablecasting to make sponsorship identification announcements when presenting matter in return for money, service, or other valuable consideration. We find that Comcast cablecast portions of a video news release (``VNR'') produced on behalf of ``Nelson's Rescue Sleep'' without also airing required sponsorship identification announcements. The Sponsorship Identification Rules The sponsorship identification rules, which are contained in sections 317 and 507 of the Communications Act of 1934, as amended (the ``Act''), and sections 73.1212 and 76.1615 of the Commission's rules, generally require that, when payment has been received or promised to a broadcast licensee or cable operator for the airing of program material, at the time of the airing, the station or cable system must disclose that fact and identify who paid or promised to provide the consideration. Specifically, section 317(a)(1) of the Act provides, in

If, however, advertisements fall within the scope of our political programming rules, and parties experience difficulty in placing such political announcements on cable systems, our rules may provide redress. All cable operators are required to abide by the Commission's political programming rules applicable to cable television. See, e.g., 47 C.F.R. §§ 76.205, 76.206, 76.1611, 76.1615, 76.1701, 76.1715. The no-censorship provision of the Communications Act of 1934, as amended, which embodies First Amendment free speech principles, prohibits the Commission from involving itself in the content of specific programs or otherwise engaging in activities that might be regarded as program censorship. Section 507 of the Communications Act establishes a reporting scheme designed to ensure that broadcast licensees receive notice of consideration that may have been provided or promised in exchange for the inclusion of matter in a program regardless of where in the production chain the exchange takes place. 5. The rules apply regardless of whether the program is primarily commercial or noncommercial and regardless of the duration of the programming. The rules do not require sponsorship identification, however, when both the identity of the sponsor and the fact of sponsorship of a commercial product
