Cox also argues that KAZH's complaint is procedurally defective because it failed to include an affidavit or a declaration as required by Section 76.6(a)(3) of the Commission's rules. Cox also contends that the instant Complaint is also deficient because it did not include ``relevant documentation,'' such as the May 2003 test results Cox provided, to support the Station's factual allegations Cox argues that even if the Complaint is properly supported, it should be dismissed because KAZH fails to deliver a good quality signal to

As of the announcement date of the proposed transaction, 1.8 million of USSB's approximately 2 million subscribers also subscribed to DIRECTV's service. Thus, DIRECTV would gain only about 200,000 consumers by acquiring USSB. Therefore, after acquiring USSB, DIRECTV would have, at most, approximately 5.94% of the 76.6 million subscribers in the national MVPD market. This change, which would be less than 1%, would be too insignificant to raise competitive concerns under the DOJ/FTC merger guidelines. We view this national analysis as descriptive of the average effect of the proposed merger across local MVPD markets. Second, according to the 1998 Cable Competition Report, as of June, 1998, 68.8%

Therefore, after acquiring USSB, DIRECTV would have, at most, approximately 5.94% of the 76.6 million subscribers in the national MVPD market. This change, which would be less than 1%, would be too insignificant to raise competitive concerns under the DOJ/FTC merger guidelines.39 We view this national analysis as descriptive of the average effect of the proposed merger across local MVPD markets. 14. While we do not have data on the individual purchases of video programming by each of these competitors, we can draw inferences from the following information. Alternatively, WIDP argues that, because of a change in ownership, WIDP had the right to renew its mandatory carriage rights against the new owners. CTI further argues that WIDP's complaint was procedurally defective because the complaint was signed by WIDP's counsel and not the complainant as required by Section 76.6(a)(4) of the Commission's rules. WIDP responds that the Commission's rules are unclear because Section 76.6(a)(4) permits all ``pleadings'' to be signed by a party's attorney but then states that complaints must be signed by the complainant. To address this issue, WIDP submits a verification of its complaint, which is signed by the president of Ebenezer Broadcasting, Inc., the licensee of

- notes that USSB's offerings are typically viewed by consumers as complementary to DIRECTV's offerings.37 As of the announcement date of the proposed transaction, 1.8 million of USSB's approximately 2 million subscribers also subscribed to DIRECTV's service.38 Thus, DIRECTV would gain only about 200,000 consumers by acquiring USSB. 14. Second, according to the 1998 Cable Competition Report, as of June, 1998,

While we do not have data on the individual purchases of video programming by each of these competitors, we can draw inferences from the following information. As of June 1998, there were approximately 98 million households with a television set ("TV households") in the United States. Of these TV households, approximately 76.6 million subscribed to the services of 33 However, as we discuss further below, EchoStar has indicated that it plans to use some of the additional channels at 110o W.L. to obtain and retransmit the signals of local terrestrial TV stations to better compete with cable TV systems. If EchoStar chooses to retransmit such programming, it may improve its ability to

According to the FCC's sixth annual report on the competitive status of markets for the delivery of video programming, a total of 80.9 million households subscribed to multichannel video programming services (i.e., cable and noncable MVPDs) as of June 1999, up 5.5% over the 76.6 million households subscribing to MVPDs in June 1998. This subscriber growth translates into a 3.2 percentage point increase in multichannel video programming subscribership to 81.4% as of June 1999, i.e., 99.4 million U.S. homes with at least one television divided by 80.9 million households subscribed to multichannel video programming services.
