- to construct and operate a non-voice, non-geostationary mobile satellite service (Little LEO) system. E-Sat is authorized to operate a six-satellite Little LEO system in the 148-148.905 MHz uplink and the 137.0725-137.9275 MHz downlink frequency bands. EchoStar now owns 80 percent of E-SAT stock, and DBSI owns the remaining 20 percent of the shares. Following the proposed transfer, DBSI will own 80.1 percent of E-SAT's stock, and EchoStar the remaining 19.9 percent. On May 24, 200, the International Bureau placed this transfer of control application on public notice. Satellite Policy Branch Information, Report No. SAT-00043. No comments or oppositions were filed. DISCUSSION Before we can approve this application, the Communications Act requires that we find the proposed transfer serves the public interest,

At that time, EchoStar owned 80 percent of the stock of E-SAT, and DBS Industries, Inc. owned the remaining 20 percent of the shares. In May 2000, E-SAT applied for authority to change the percentage of ownership in E-SAT to DBSI owning 80.1 percent of the E-SAT stock, and EchoStar owning the remaining 19.9 percent of the shares. On November 21, 2000, the Bureau approved the transfer of control application, based on the applicants' assertion that grant of the transfer would facilitate implementation of the E-SAT system. DISCUSSION It is longstanding Commission policy to impose milestones for system implementation, typically deadlines by which

- we dismiss both applications as defective. Specifically, in both applications Qualcomm list the value of the Maximum EIRP Density per Carrier for emission designator 11M0G7W as 40.67 dBW/4 kHz. This is less than and therefore inconsistent with the average value of 45.71 dBW/4 kHz we derive from the bandwidth of the emission and the Maximum EIRP per Carrier value of 80.1 dBW. Given this inconsistency, we cannot determine the proposed emission power. Accordingly, pursuant to Section 25.112(a)(1) of the Commission's rules, 47 C.F.R. §25.112(a)(1), and Section 0.261 of the Commission's rules on delegations of authority, 47 C.F.R. §0.261, we dismiss both applications without prejudice to refiling.
