- STA within six months and possibly apply for a new STA after the extension expires. We propose to reduce this organization's administrative burden and reduce the Commission's workload by codifying use of 121.95 MHz for air-to-ground and air-to-air communications for aircraft up to 13,000 feet above mean sea level between Imperial Beach, California and Tecate, Mexico in 47 C.F.R. 87.187. Such a codification would be similar to other portions of our rules applicable to other geographic areas. We seek comment on this proposal. We note, as an initial matter, that we have granted similar waivers regarding aviation transceivers with an extended frequency range and dual spacing transceivers. With regard to aviation transceivers operating on extended frequency range and transmitting on VHF military frequencies, we note that Section 87.187(a) of the Commission's Rules permits aircraft stations to use frequencies assigned to government aeronautical stations. We believe that Rockwell Collins has established that the public interest would be served by grant of a waiver of Section 87.173 of the Rules to permit certifications of Rockwell Collins aircraft transceivers capable of operating on government frequencies in addition to the standard VHF

The specific rule provisions we propose to amend are: (1) 47 C.F.R. 87.131 (Power and emissions); (2) 47 C.F.R. 87.133 (Frequency stability); (3) 47 C.F.R. 87.137 (Types of emission); (4) 47 C.F.R. 87.139 (Emission limitations); (5) 47 C.F.R. 87.173 (Frequencies) [General List]; (6) 47 C.F.R. 87.187 (Frequencies) [Aircraft Stations]; and (7) 47 C.F.R. 87.263 (Frequencies) [Aeronautical Enroute and Aeronautical Fixed Stations]. We believe that these changes would serve to promote the transition from analog voice communications to digital voice and data transmissions. NBAA contends that recent studies indicate a twenty percent per annum growth in the use of the 136-137 MHz band for data communications

- the 136-137 MHz band. However, the Commission also tentatively concluded that, contrary to SAMA's suggestion, designating four specific channels for FIS in footnote US244 was not necessary and might curtail flexibility. Nonetheless, the four channels favored by the FAA for FIS ( 136.425 MHz, 136.450 MHz, 136.475 MHz, and 136.500 MHz ( were designated as such in proposed new Section 87.187(dd), along with a prohibition on their use for transmissions from aircraft. The Commission also requested comment on whether the new service should be termed ``Flight Information Service (FIS),'' as used in both the FAA and SAMA Petitions, or ``Flight Information Service-Broadcast (FIS-B),'' as used by ARINC in its comments. The Commission questioned whether FIS-B and FIS are synonymous or whether

- Ku-Band Based on information submitted by Boeing indicating that there are no present or planned uses of the Ku-band (14.0-14.5 GHz) for radionavigation service in ITU Region 2, the Commission proposed in the FNPRM to remove the Ku-band allocations for radionavigation from the Commission's Rules. The Commission specifically proposed to remove the reference to the 14000-14400 MHz band in Section 87.187(x) of the Rules and also to remove from the Table of Frequency Allocations the allocation for radionavigation in the 14000-14200 MHz band. NTIA and ARINC both agree that the Ku-band allocations for radionavigation should be eliminated. The record demonstrates that there is no existing or anticipated need to use the Ku-band spectrum for radionavigation. We accordingly adopt this Commission proposal.

- predecessor, asserting that the frequency has not been used, and is not needed, for FIS-B, but is needed for aeronautical enroute service. NTIA opposes removal of 136.475 MHz, however, because that frequency is still required for FIS-B. The record, in sum, clearly indicates that we should retain 136.475 MHz for FIS-B use, while removing 136.500 MHz. We will amend Section 87.187(dd) accordingly. Frequencies for Air-to-Air Use in Hawaii The Commission proposed in the Second FNPRM to codify the terms of a Wireless Telecommunications Bureau grant of special temporary authority (STA) to the Hawaii Air Tour Safety Working Group (HATSWG). - an MSS system in the licensing phase of this proceeding. In addition, the Notice explained that the Commission's rules have specific requirements concerning licensing of terminals for aviation distress and safety communications. These rules explicitly state which frequency bands may be used for aircraft-to-satellite AMS(R)S transmissions and do not include the 1990-2025/2165-2200 MHz bands. Iridium and ARINC state that Part 87.187 and the U.S. Table of Frequency Allocations would need to be amended to permit the operation of Boeing's terminals, yet no rulemaking is pending. Boeing states that it intends to file a petition for rulemaking with the Commission seeking a revision of Part 87 to permit aeronautical Earth stations to operate in the 2 GHz MSS frequency bands but does
