- Form 601 Main Form and Schedule K. New applicants in the 4.9 GHz band may apply for primary permanent fixed stations in a similar fashion, but must file a new application rather than a modification. Self-Certification As with general 4.9 GHz authorizations, applicants for 4.9 GHz primary permanent fixed stations are not subject to formal frequency coordination requirements. However, Section 90.1209(b) of the Commission's rules requires that ``[a]ll licensees ... cooperate in the selection and use of channels in order to reduce interference and make the most effective use of the authorized facilities.'' Applicants for 4.9 GHz primary permanent fixed stations should review the Commission's database for potential interference. Section 90.155 is amended by revising paragraph (a) to read as follows: § 90.155 Time in which station must be placed in operation. (a) All stations authorized under this part, except as provided in sections 90.528, 90.529, 90.629, 90.631(f), 90.665, 90.685, and 90.1209, must be placed in operation within twelve (12) months from the date of grant or the authorization cancels automatically and must be returned to the Commission. * * * * * Section 90.175 is amended by revising the title of paragraph (e), revising paragraphs (j) (10), (11) and (12) and adding a new paragraph (j)(18) to read as follows: §

- we have concerns about ensuring interference protection among primary permanent fixed stations, and we tentatively conclude therein that a more formal licensee-to-licensee coordination process may be necessary for such stations. Accordingly, until the Commission resolves a potential new coordination requirement, applicants seeking primary status for 4.9 GHz permanent fixed stations must ensure that they meet the minimum requirements of Section 90.1209(b). Further, we believe it prudent to distinguish between primary permanent fixed stations and secondary stations in our licensing database. The Commission has established station class codes in the past to distinguish between licensees that are subject to different regulatory requirements on the same set of frequencies. Similarly, in this instance, establishing a new class code for primary permanent fixed stations

However, as Motorola concedes no standard has emerged that would provide the mix of frequency band, center frequencies, interoperability and detailed security features needed for 4.9 GHz band operations. - situation, and (ii) improved spectrum efficiency, which would allow more entities to use the 4.9 GHz band for wireless broadband communications. We therefore are seeking more information on the benefits and costs of implementing such a procedure. Specifically, are the Commission's concerns from the Further Notice as recounted above sufficiently valid to warrant a more formal coordination requirement? Is Section 90.1209(b) sufficient as it is? Are there interference issues today that cannot be resolved by the requirements of this rule? How would the 4.9 GHz license environment look if the Commission does not alter 4.9 GHz coordination requirements? If commenters agree with the Commission's concerns, are there non-regulatory alternatives to new coordination procedures? Part 101 approach Background and prior comments. In
