- Bayonne's proposed operation ``presents the question of interference to adjacent channel operations in the southern part of Bergen County.'' Further, Bergen noted that Bayonne did not present a technical analysis regarding potential harmful interference resulting from its proposed radio system, and failed to ``indicate why the Commission's allocation of 14 UHF channels for low power purposes, Section 90.20(d)(84) and Section 90.267, would not meet its requirement.'' However, on December 19, 2008, Bergen withdrew its opposition to Bayonne's waiver request based on Bergen's December 18, 2008 authorization to use frequencies 470.1625 and 473.1625 MHz with narrow bandwidth under call sign WPZH865. On April 2, 2009, Bayonne amended its application to request a new base station on frequency 470.1500 MHz with increased power

Thereafter, on June 29, 2000, the Wireless Telecommunications Bureau (WTB) announced the acceptance of the LMCC's Low Power Plan. DISCUSSION Current Low Power Plan (450-470 MHz Band) Section 90.267 of the Commission's Rules provides that any regularly assignable channel in the 450-470 MHz PLMR band may be designated by the frequency coordinators as a low power channel in a defined geographic area. Low power stations authorized under this Section are limited to two (2) watts output power. The Low Power Plan accepted by WTB designated 104 ``12.5 kHz offset''

- June 15, 1995, the Commission adopted a Report and Order in PR Docket No. 92-235, (Refarming proceeding), to promote more efficient use of the private land mobile radio (PLMR) spectrum below 512 MHz. Under the rules adopted, channels in the 450-470 MHz band that were 12.5 kHz removed from regularly-assignable channels and reserved for low power operation under former Section 90.267 of the rules (``12.5 kHz offset channels''), were reclassified as regularly assignable channels available for high power operation. In making this change, however, the Commission recognized the continuing need for low power channels and tasked the Part 90 frequency coordinators with devising a low power plan through industry consensus. On March 12, 1997, the Commission adopted a Second Report and

- (APCO) requested that the Commission investigate an interference problem between Lemont's Station WPFS667 and D&I's Station WPGQ917. APCO stated in its June 28, 1999, letter that the interference sounded like data bursts from D&I's Station WPGQ917 bleeding over into the input of Lemont's adjacent Station WPFS667. Additionally, APCO stated that ``D&I Electronics was issued frequency 465.9875 MHz per FCC Rule 90.267, which is on a secondary basis to primary users. D&I Electronics has been notified by APCO that they are responsible for correcting the interference, however, nothing has been done to resolve the problem.'' Subsequently, on July 5, 2000, the Commission received a letter from Lemont, complaining that its Station WPFS667 was receiving interference from D&I's Station WPGQ917. In this connection,

At the conclusion of the investigation, the Branch confirmed the interference and determined that D&I's operation of Station WPGQ917 is secondary to Lemont's operation of Station WPFS667. Specifically, the Branch noted that D&I had not fully complied with Section 90.267(b) of the Commission's Rules, which provides that licensees operating with an emission designator wider than 11.25 kHz, as of August 5, 1999, on certain frequencies including those on which D&I operates, may obtain primary status with respect to co-channel licensees by supplying their coordinates to the Commission. Further, Bergen noted that Bayonne did not present a technical analysis regarding potential harmful interference resulting from its proposed radio system, and failed to ``indicate why the Commission's allocation of 14 UHF channels for low power purposes, Section 90.20(d)(84) and Section 90.267, would not meet its requirement.'' DISCUSSION Section 90.267 of the Commission's Rules provides that any regularly assignable channel in the 450-470 MHz PLMR band may be designated by the frequency coordinators as a low power channel in a defined geographic area. Low power stations authorized under this Section are limited to two (2) watts output power. The Low Power Plan submitted by the coordinators and accepted by WTB

Hospitals and health care facilities holding a valid license to operate a radio station under Part 90 may operate medical telemetry equipment without any specific authorization from the Commission (see 47 C.F.R. 90.267).
