Plaincom had argued, inter alia, that the December Amendment contained a clerical error, and that the February Amendment, which attempted to correct this error, was an amendment of right, effective upon filing. The Division determined, however, that the February Amendment was properly dismissed because it did not satisfy the requirements of Section 101.45(f) of the Commission's Rules, in that there was no evidence within the four corners of the December Amendment to indicate a clerical error existed. - on Channels 4A/B and 13A/B in New York, NY. On October 21, 1994, DCT filed an amendment to its New York application to request only Channel 2A/B. Because DCT's original application did not contain a request for Channel 2A/B, it was deemed that DCT's October 21, 1994, amendment requesting Channel 2A/B was a major amendment pursuant to Sections 101.29(c)(1)(i) and 101.45(c) of the Commission's Rules. Thus, DCT's application received a new filing date of October 21, 1994, which was more than sixty days after the July 6, 1994, public notice announcing the acceptance of WinStar's applications for filing. On November 28, 1995, DCT filed amendments to both its Spokane and Kalamazoo applications in order to resolve any mutual exclusivity that existed with Milliwave's first-filed applications. On April 28, 1999, the Division released an Order granting Milliwave's petition to deny and dismissing the DCT applications. The Division concluded that the DCT applications were untimely pursuant to Section 101.45(b) of the Commission's Rules, because they were filed more than sixty days after the Milliwave applications with which they conflicted were placed on public notice. Discussion. On August 25, 1995, WinStar filed a 39 GHz application for Channels 11A and 11B in the area of Stockton, CA. WinStar's application conflicted with the referenced applications filed by GEC and Biztel. On December 10, 1996, Biztel's application was dismissed as defective. Under Section 101.45(b) of the Commission's Rules, no application will be entitled to be included in a random selection process or to comparative consideration with a previously filed application unless such application is substantially complete and tendered for filing within sixty days after the date of the public notice listing the first of the conflicting applications as accepted for filing. The Branch found that Likins's applications conflicted with the previously-filed AT&T and Bay Area applications, and that, because Likins's applications were filed more than sixty days after the first-filed applications, Likins's applications were untimely pursuant to Section 101.45 of the Commission's Rules.
